By accessing or using Starling Homeschool Planner (“the Service”), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Starling Homeschool Planner is an online platform designed to assist Australian homeschool families in tracking curriculum progress, managing educational activities, and planning lessons aligned with the Australian Curriculum and Assessment Outline.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account. We offer two-factor authentication (2FA) to help protect your account and we encourage all users to enable it.

4. Subscription and Payments

After the trial week, features of the Service require a paid subscription. Subscription fees are charged in advance on a recurring basis. You may cancel your subscription at any time. Refunds are provided at our discretion in accordance with Australian Consumer Law.

5. Intellectual Property

All content, trademarks, logos, and intellectual property on the Service are owned by or licensed to Starling Homeschool Planner. You may not reproduce, distribute, or create derivative works without our express written permission.

6. User Content

You retain ownership of content you upload to the Service. Any photos or details you add to your account, remain on your account only. Your content will not be accessed or shared with any other user or any platform.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Record Keeping Service Only

Starling Homeschool Planner is a record keeping service only. We take no responsibility for children meeting the expectations of moderators or other governing bodies. It is the sole responsibility of the parent or guardian to ensure compliance with any applicable educational requirements, regulations, or standards set by moderators, government departments, or other governing bodies.

9. Limitation of Liability

To the maximum extent permitted by Australian law, Starling Homeschool Planner shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the new Terms.

11. Governing Law

These Terms are governed by the laws of Western Australia, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Western Australia.
